Esiste una precisa norma giuridica che riconosce la competenza del biologo a prescrivere diete?
Con riferimento al tema della competenza del biologo a prescrivere diete, si osserva che questa competenza è espressamente riconosciuta dalla legge e anzi si può aggiungere che il biologo è l’unico professionista, a favore del quale esiste una precisa norma giuridica di rango legislativo, che riconosce la sua competenza a valutare i bisogni nutritivi e a prescrivere le conseguenti diete. L’art. 3 della legge 24.5.1967, n. 396 afferma testualmente che formano oggetto della professione di biologo le attività di “valutazione dei bisogni nutritivi ed energetici dell’uomo”. Del resto la stessa autorevole giurisprudenza amministrativa ha confermato che oltre alla legge costituisce fondamento delle competenze del biologo il predetto decreto del Ministero di Grazia e Giustizia n. 362/93 (v. Cons. Stato, sez. V, 16.11.2005, n. 6394, in Foro Amm. Cons. St. 2005, 3305).
